McGuinty government rules out use of sharia law
Following widespread condemnation of a plan that would formally allow the tenets of sharia to be used in resolving family disputes, the Premier said he'll make the boundaries between church and state clearer by banning faith-based arbitrations. (Huzzah!!!)
Ontario explicitly gave the green light to such practices in its 1991 Arbitration Act. But as early as this fall, new Ontario laws may put a stop to religion-based settlements in matters such as child-custody disputes or inheritances.
some facts: Shari'a is a Muslim set of laws designed to settle family disputes, often criticised by westerners as being sexist and a huge step backward for individual human rights.
btw here's where it's gets interesting
banning Shari'a law has other rammifications: it also bans jewish and christian groups from having religious arbitration laws ...so this is opening the door for other religious groups to challenge the constitutionality of the banning as it may conflict with the canadian charter of rights (canadian bill of rights). Hopefully it wont come to that as I personally see this as a step forward in having a truely secular government (which is how it should be)
