Madness: Trapped in Elevator Car 30

More like "Damn this is boring! Im going to sue them for inconveniencing me!".

not likely:

He began hearing unlikely oscillations in the ringing: aural hallucinations. Before long, he began to contemplate death.

It wasn?t hot, yet he was sweating. His wallet was damp. Maybe a day had passed. He drifted in and out of sleep, awakening each time to the grim recognition that his elevator confinement had not been a dream.

And then he gave up. The time passed in a kind of degraded fever dream.

His friends turned to see him and were appalled at the sight; he looked like a ghost, one of them said later.

Doesnt sound like the instantly dismissed threat thrown in with cries for help to me that you make it sound like. Even while he was inside the elevator car he was thinking about getting some monetary compensation for it.

yes ...

At a certain point, Nicholas White ran out of ideas. Anger and vindictiveness took root. He began to think, They, whoever they were, shouldn?t be able to get away with this, that he deserved some compensation for the ordeal. He cast about for blame. He wondered where his colleague was, why she hadn?t been alarmed enough by his failure to return, jacketless, from smoking a cigarette to call security. ?Whose fault is this?? he wondered. ?Who?s going to pay?? He decided that there was no way he was going to work the following week.

after 41 hours I'd be ready to sue the queen ffs; it's a natural reaction to being trapped dsue to no fault of your own ..simply saying "well he's suing the company" isnt evidence that he's taking the system for a ride because if that were true it would mean the end of litigation period

How is it clear he wasnt in a good state of mind? He talked to the guards, remembered to grab his jacket before he left, and went to a bar for ****s sake.

he went home first, dont forget that little detail ..and again how is that evidence he wasnt suffering from duress ..could you stand being in a confined place for an hour never mind 41?

Yes, because theres no other explanation as to why a company would settle rather than get brought to court. It definately couldnt be that they didnt want to pay the expenses of lawyers or drag this on longer at their own cost, nor could it have been any of numerous other reasons why a company would avoid going to court.

had they taken it to court and won they could have recouped 100% of their lawyer fees ..no they had a reason why not to go to trial; thye obviously didnt think they'd win

A few stupid rulings by a few stupid courts isnt representative of the entire judicial system.

you're putting words in my mouth ..I'm saying that in a litigious country like the US where it's citizens sue for the slightest affront isnt it plausible that he's not one of them?

I doubt he would have gotten anywhere near 1 million dollars if he took it to court, and he would have lost a lot more money in lawyer fees.

not neccessarily, they could have been in the discovery phase of the case (right before trial) ..something must have come up for the company to offer a settlement after 4 years

Not to mention he was already broke from not having a job for 4 years. I think there are a lot more reasons why he would want to settle than the company would.

he isnt in a position to settle anything, that's up to the company ..he is the defendent

He's not the defendant. The company isn't suing him is it? He's the plaintiff.

I didn't read what you guys are talking about, but I assume it's about him suing the company. That makes him the plaintiff since he initiated the lawsuit.

whoops ..right sorry my mistake ..too much law and order for me

Hes the defendant when hes suing someone? And if he could have won the case, then why would he accept the settlement? Why would he accept the "hardly six figure" settlement if he couldve won millions?

EDIT: K, nevermind my first sentence :P

there's a ton of reasons why he could have settled ..for all we know that was the advice of the lawyers who probably wanted to collect something after 4 years ..again the company wouldnt have settled if they had an ironclad case: they had nothing to lose and everything to gain
