If you are using someone else's Intellectual property (eg, copyrighted characters, ideas, maps, music, movies, images, software, etc) then you must have their permission. "commercial development" only affects how much you'll be sued for.
 
Every person that has made something unique (I.e. a picture) , has basic rights over it and don't have to pay for these. (Ideas aren't part of this)
-Right of owning : You have the right to own anything you made.
-Copyright : If someone steals your work (the actual thing, not a copy), I think it's possible to sue them for it if he makes profit out of it. If you can't, do it anyways, especially if you live in America. You can sue you neighbours cat for scratching you over there :/
-Probably some others.
 
Looks like the OP realised he was wrong about the "legal issues" of mod development then..
