Sharing an obscene sexual fantasy over e-mail is a federal crime that enjoys no protection under the First Amendment, a federal appeals court said Monday, in a decision that drew sharp dissent from one judge and potentially set the stage for a Supreme Court appeal.

In a 10-1 decision, the 4th U.S. Circuit Court of Appeals declined to rehear the case of Dwight Whorley, a Virginia man whose criminal trial marked two firsts for the American justice system: the first conviction for possession of obscene Japanese manga, and the first for authoring pornographic fiction and sending it over e-mail.

More surprisingly, prosecutors charged him under an older statute outlawing the possession of “any obscene, lewd, lascivious or filthy book, pamphlet, picture, motion-picture film, paper, letter, writing, print or other matter of indecent character” as defined by a jury. That violation was for writing out his sexual fantasies involving children, and e-mailing them to like-minded internet friends. Though Whorely is apparently a pedophile, the law applies to any obscene content.

****ing bullshit law. Not only for prosecuting someone for something that harms no one, but also because it's so ****ing vague. Laws should be well defined.

...but this is the US. where are all the people who continually scream freedom of speech whever someone makes a racist remark? surely this would draw more attention than Don Imus Nappy remarks

Ha, this is common to almost all politicians. I've been doing a linguistics unit this term and it's incredible the extent to which journalists and statesmen just completely ignore, or even acknowledge and mock, the scholars. It's not that I necessarily have a trust in academia: 'leave it to the knowledgeable' can so easily lead to 'leave it to institution x'. But it's like "ha, those crazy guys who've made it their life's work to study this phenomenon are wrong. I know better, and unlike them, I am not so weak as to need an evidential justification!"

I didn't mean to seem like I was butting in with "Oh yeah I know listen to this"! Linguistics feeds into the politics of 'declining' language, correctness, Standard English, what kind(s) of english should be taught in schools, regional grammars, 'political correctness', etc. More often than not these are tied into debates about the state of the nation, youth culture, education policy, 'declining values' and so on. Suffice to say that there's rarely any kind of descriptive basis for prescriptive opinions.
 
This is one of those things that is colossally stupid, but ultimately it doesn't inspire much opposition. The law is only as ridiculous as the stuff it prohibits.
 
What say do these mindless ****s have what people send in their own PRIVATE e.mails? Are they going to start going through are post next? Is nothing sacred? What is the big ****ing deal with PORN? Why is sex considered EVIL? it's just SEX! For god's sake... I want to commit mass murder every time one of these dumbshits comes up with a new law, that is just going to cost my family more tax money, and will fail and cease to be in a few weeks. This is getting ridiculous.

EDIT: Minus the child pornography. The guy can burn for that, for all I care. I just view this whole thing as an invasion of privacy.
